Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you and AgboFinder Wellness Services Limited (RC [RC-NUMBER]), the operator of AgboFinder (“AgboFinder”, “we”, “us”, or “our”), and govern your access to and use of the AgboFinder web portal at web.agbofinder.com, our mobile applications, and related services (together, the “Service”).

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Terms of Use, and our Cookie Policy. If you do not agree, you must not use the Service.

• User — any person who accesses the Service, including community contributors.
• Vendor — an approved seller of herbal products on the marketplace.
• Practitioner — a verified traditional-medicine practitioner who authors remedies and answers community questions.
• Content — text, images, remedies, product listings, reviews, questions, answers, and any other material submitted to or displayed on the Service.

You must be at least 18 years old and able to form a legally binding contract to use the Service. The web portal is for existing AgboFinder account holders; accounts are created in the AgboFinder mobile app.

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at support@agbofinder.com if you suspect unauthorized use. We may refuse, suspend, or terminate accounts at our discretion as described below.

AgboFinder is a digital platform for documenting, verifying, and discovering traditional West African herbal medicine, and for connecting users with verified vendors and practitioners. It provides educational and informational content and a marketplace.

AgboFinder is not a pharmacy, hospital, clinic, or licensed medical provider. We do not practise medicine, dispense prescriptions, or provide diagnosis or treatment. Information on the Service is for general educational purposes only.

Some plants are toxic or interact dangerously with medications. Where our data indicates a high or critical safety risk, the Service displays prominent safety warnings (including a “Red Banner” overlay) and mandatory disclaimers. You must read and respect these warnings. Reliance on any information from the Service is strictly at your own risk.

Using the Service does not create a doctor–patient, pharmacist–patient, or any other professional relationship between you and AgboFinder, its vendors, or its practitioners.

You agree to use the Service lawfully and to:

• provide accurate, current, and complete information;
• comply with our Terms of Use (acceptable use and community conduct);
• not misuse, disrupt, or attempt to gain unauthorized access to the Service;
• not post false, misleading, harmful, or unlawful Content, including unsafe health guidance.

If you are approved as a Vendor, you additionally agree that you will:

• hold all licences and registrations required by law, including, where applicable, valid NAFDAC registration, and provide accurate verification documents;
• list only products you are legally permitted to sell, with accurate names, descriptions, pricing, stock, safety information, and mandatory disclaimers;
• not list prohibited, counterfeit, adulterated, expired, or unsafe products;
• fulfil confirmed orders promptly and handle delivery, cancellations, and refunds fairly;
• pay applicable platform and transaction fees. Prices and amounts are processed in kobo (₦1 = 100 kobo); payouts are subject to our verification and settlement processes.

You are solely responsible for the products you sell and for compliance with consumer-protection, tax, and product-safety laws. You agree to indemnify us in respect of claims arising from your products as set out below.

If you are a verified Practitioner, you additionally agree that you will:

• provide truthful credentials and submit to our verification process;
• author remedies and answers responsibly, including required dosage, contraindication, and safety information, and the mandatory disclaimer on every remedy;
• not provide individualized diagnosis, prescriptions, or treatment through the Service;
• not present unverified claims as established medical fact.

Published remedies may be reviewed by our team before promotion. We may decline, edit, label, or remove Content that does not meet our safety standards.

You retain ownership of Content you submit. By submitting Content, you grant AgboFinder a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt, translate, publish, and display that Content for the purpose of operating, improving, and promoting the Service.

You represent that you have the rights to grant this licence and that your Content does not infringe any third-party rights or violate any law. We may moderate, review, or remove Content, and may suspend contributors who breach these Terms.

The Service, including its software, design, branding, logos, and curated content, is owned by AgboFinder Wellness Services Limited or its licensors and is protected by intellectual-property laws. Except for Content you own, you may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written permission.

Marketplace purchases are contracts between buyers and Vendors. AgboFinder facilitates listings, orders, and payments but is not the seller of Vendor products. All monetary values are handled in kobo and displayed in Naira.

Platform fees, delivery fees, and any applicable taxes are shown before checkout. Refunds, returns, and cancellations are handled in line with the relevant Vendor’s policy and applicable consumer-protection law. We may reverse transactions in cases of fraud, error, or policy breach.

Prohibited activities are detailed in our Terms of Use. Breach of those rules is a breach of these Terms and may result in removal of Content, suspension, or termination, and where appropriate referral to the authorities.

The Service may integrate or link to third-party services (for example payment processors, media hosting, and mapping). We are not responsible for third-party content, products, or practices, and your use of them is governed by their own terms.

The Service and all Content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any remedy, product, or information will be safe or effective for you.

To the maximum extent permitted by law, AgboFinder Wellness Services Limited, its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or for personal injury or health outcomes, arising from your use of (or inability to use) the Service or any Content, even if advised of the possibility. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

You agree to indemnify and hold harmless AgboFinder Wellness Services Limited and its team from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your Content, your use of the Service, your products or services (for Vendors and Practitioners), or your breach of these Terms or applicable law.

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms, create risk or legal exposure, or for prolonged inactivity. You may stop using the Service at any time. Provisions that by their nature should survive termination (including ownership, disclaimers, liability limits, and indemnities) will survive.

We may modify the Service or these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts of Lagos State, Nigeria for any dispute arising out of or relating to these Terms or the Service, subject to any mandatory consumer rights available to you.

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization or sale. These Terms, together with the policies referenced above, are the entire agreement between you and us regarding the Service.
